O.M.P.(MISC.)(COMM.) 50/2024 By way of the present petition filed under section 29A(4) and

(5) of the Arbitration & Conciliation Act 1996, the petitioner seeks extension of mandate of the learned Arbitral Tribunal for a period of 06 months. The first session of the learned Arbitral Tribunal was held on 17.07.2021.

Learned counsel appearing for the petitioner submits that the Tribunal has been granted one consensual extension; and this petition is the first time that a court extension has been prayed-for. 3.

Mr. Binay Kumar, learned counsel appearing for the respondent submits that the respondent does not wish to file reply in the matter. Counsel further submits that the respondent does not object to the extension of the mandate of the learned Arbitral Tribunal as prayedfor, except that he prays that since the matter has been pending for more than 02 years, the arbitral proceedings may be concluded at the earliest.

Attention of this court is drawn to order dated 04.01.2024 made by the learned Arbitral Tribunal, observing that its mandate has expired. Learned counsel for the parties submit that the matter is at an advanced stage and arguments on the counter-claims filed by the respondent are ongoing.

Upon a conspectus of the averments contained in the petition and the submissions made, the petition is allowed. The mandate of the learned Arbitral Tribunal is extended, as prayed-for, by a period of 06 months from today; further observing that any steps that may have been taken in the arbitral process in the past period, shall also stand validated and regularised.

The learned Arbitral Tribunal is requested to conclude the proceedings within the period of the extended mandate. 8.

The petition is disposed-of in the above terms. 9.
