The present writ petition has been filed seeking directions to respondent nos. 1 to 4 to stop and demolish the unauthorized construction of a banquet hall/ Barat Ghar being carried out on agricultural land bearing Khasra Nos. 85/172, situated in the revenue estate of Village Bijwasan, New Delhi.

violation of the restraint order dated 10th October, 2025 issued by the SDM, Kapashera as well as in violation of the circular dated 17th August, 2022, issued by the respondent no.1/MCD with respect to the "Policy for Holding Social Functions in Eligible Farm Houses" within the jurisdiction of the MCD.

Attention of the Court has been drawn to previous writ petitions filed by the petitioner Association, wherein this Court has passed restraint orders against similar unauthorized constructions. More specifically, attention has been drawn to an order passed by the Predecessor Bench on 20th November, 2025, passed in W.P. (C) 17639/2025, filed by the petitioner Association against the respondent no.1/MCD.

Mr. Dutta, Standing Counsel appearing on behalf of the respondent no.1/MCD submits that a show cause notice has been issued to the owner/ builder of the aforesaid property on 20th January, 2026 and a work stop order dated 21st July, 2025 has been issued to the concerned SHO. 4.1.
The aforesaid documents have been handed-over in Court today and are taken on record.

Copies of the aforesaid documents have also been supplied to counsel appearing on behalf of the respondent no. 6.

Considering the submissions made before this Court, the MCD shall take appropriate action, in accordance with law. 7.
Further, the MCD shall also be at liberty to inspect the farm house in question, i.e., the farm house of the respondent no. 5 and 6, in order to verify the use of the said farm house and the extent of construction existing therein. The MCD shall ensure that its Circular of 2022 regarding holding of social functions in farm houses, is strictly followed. At the time of the inspection, the concerned officials of the respondent no.1/MCD shall keep in mind the various issues, as raised in the present writ petition.

It is further directed that at the time of the inspection by the respondent no.1/MCD, the requisite Police assistance shall also be provided by the SHO, Police Station, Kapasehra.

Further, in case of any complaint by any member of the petitioner association, the concerned officials of the MCD as well as SHO, Police Station Kapasehra, shall ensure that the said complaints are considered at the earliest and relevant action is taken in this regard. 11.
