O R D E R

Heard learned counsel representing the parties. 2.

This Court on 12.02.2026 passed the following order:- "1. Heard learned counsel representing the parties.

2. Having noticed the facts and circumstances of the case, we are of the opinion that a chance can be taken by the parties to settle the issues between them outside the Court. The compensation awarded to the appellant by the learned Labour Court was Rs.10,43,928/- along with interest @ 18%. Besides, the appellant was also awarded litigation cost of Rs. 10,000/-. The award of the learned Labour Court was declared in the year 2008. The services of the appellant were terminated on 17.02.1999.

3. The appellant was employed as a Class-IV employee with the respondent/Company and on account of termination of his services and thereafter, prolonged litigation, he has already suffered. He is said to have even attained the age of superannuation about 12 years ago.

In these circumstances, when we enquired from the learned counsel for the appellant as to whether some settlement between the parties can be arrived at, learned counsel for the appellant The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. states that the appellant shall be satisfied, if he is paid lump sum amount between Rs. 8,00,000/- to Rs. 10,00,000/-.

5. Learned counsel for the respondent/Company shall seek instructions in this regard by the next date of hearing.

6. We may emphasise that respondent/Company shall consider this aspect of the matter considering the fact that the appellant has already undergone considerable sufferings. We hope and expect that learned counsel for the respondent will be able to use her good offices to persuade the respondent to come to a settlement, if possible in the aforesaid terms.

7. List on 20.02.2026.

Learned counsel for the respondent/Company on instruction has stated that the respondent/Company has agreed to pay a sum of Rs.10,00,000/- to the appellant towards the full and final settlement of all the disputes between the parties.

The offer made by the respondent/Company is acceptable to the appellant as already noticed in our order dated 12.02.2026. 5.

Accordingly, we dispose of this appeal in terms of the aforesaid settlement. The respondent/Company shall make the payment of the amount of Rs.10,00,000/- to the appellant within 06 weeks from today. 6.

Before we part with this matter, we put on record our appreciation for learned counsel for the respondent/Company for her ablest assistance provided to the Court which has resulted in settlement of the issues between the parties amicably.
