The present petition has been filed under Section 397 read with Section 401 CrPC seeking setting aside the impugned order dated 06.09.2024 whereby the ad interim maintenance@ Rs.6,000/- per month has been awarded to the respondent.

On a query posed by the Court, the learned Counsel for the petitioner submits that when the ad interim maintenance was awarded, the income affidavits of the parties had not come on record. Subsequently, both the parties have filed their income affidavits in terms of decision of the Hon'ble Supreme Court in "Rajnesh vs. Neha; (2021) 2 SCC 324". 5.

respondent's application for ad interim maintenance on 07.02.2025. 6.

In view of the above, the learned Trial Court is directed to expedite the disposal of application seeking interim maintenance, preferably on the next date, regard being had to the income affidavits of the parties. 7.

With the aforesaid direction, the petition stands disposed of with liberty to the petitioner approach this Court against the order of interim maintenance, if so advised.
