This is an application under Section 483, BNSS, 2023 filed on behalf of the applicant/accused Rahul Dabas @ Kapil in case FIR No. 170/2024, PS Special Cell, under Section 221/132/109/3(5) BNS, (186/353/307/34 IPC) & 25/27 Arms Act.

Learned counsel for the applicant submits that applicant has been in custody since 24.04.2024. Investigation is complete and charge sheet has already been filed in court. He further submits that there is no public witness of the incident nor any CCTV footage of the incident. The trial has yet not commenced.

Learned counsel further submits that petitioner was granted interim bail twice, but he did not misuse the liberty of grant of bail. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The application has been opposed by the learned APP submitting that applicant had fired on the NCB officials and one of the bullets struck one of the members of the team, but luckily, he survived as he was wearing bullet proof jacket. He further submits that applicant is a hardened criminal, involved in as many as eight cases including the present one and was a Proclaimed Offender in case FIR No. 603/2019, under Section 302/324/326/341/34/174-A/201 IPC, PS Prem Nagar. He apprehends that applicant being a habitual criminal and may jump the bail, if granted. 5.
As per allegations, a specific information was received at Special Cell that a wanted criminal would arrive at Sector-36, Rohini with firearms to commit some crime. Upon this information, a trap was laid. Applicant came in a Swift car and when he was given signal to stop the car by the NCB officials, he started firing on the police party. Total five rounds were fired by him and NCB officials team also fired in self defence and managed to apprehend the applicant. During the incident, one of the bullets fired by the petitioner, hit an NCB official, but he was saved due to bullet proof jacket. 6.
If the allegations are to be believed at this stage, applicant indulged in daring act of firing at the NCB officials. Status Report reveals the involvement of the applicant in seven more cases. The applicant therefore has propensity to commit crime. He was declared Proclaimed Offender in case FIR No. 603/2019. The possibility that upon being released on bail, he may jump the bail, cannot be ruled out at this stage. The trial is still at a nascent stage.

Keeping in view the entire facts and circumstances and the nature and gravity of allegations and the past criminal antecedents, the Court is not inclined to grant bail to the applicant/accused at this stage.
