O R D E R

% 08.08.2024 CM APPL. 45449/2024 (Seeking modification of the order dated 26th July, 2024) 1.

The instant application under Section 151 of the Code of Civil Procedure, 1908 has been filed on behalf of the applicants/petitioners seeking modification of the order dated 26th July, 2024. 2.

Learned senior counsel appearing on behalf of the petitioners submitted that vide order dated 26th July, 2024, this Court was pleased to grant status quo with respect to the alleged removal of the applications/petitioners as directors from M/s Rack Story Pvt. Ltd. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that in the order dated 26th July, 2024, even though this Court verbally granted status quo ante, however, the same was inadvertently not recorded in the aforesaid order. Hence, it is prayed that the above mentioned order may be modified to the extent that it records the grant of status quo ante.

Learned senior counsel appearing on behalf of the petitioners also prayed that for filing the representation before the Registrar of Company, the time period of one week may be granted from today. 5.

Learned counsel appearing on behalf of the respondent does not have any objection to the submissions and prayer made on behalf of the petitioner.

Heard the learned counsel appearing on behalf of the parties and perused the material on record.

For the sufficient cause being shown in the application and no objection on behalf of the respondent, the same is allowed and the paragraph no. 8 of the order dated 26th July, 2024 is modified to the extent that it shall now be read as under:

"Accordingly, status quo ante shall be maintained as regards the directorship of the Petitioners in M/s Rack Story Pvt. Ltd till the decision of the Registrar of Company i.e. Union of India.

Further, the petitioners are directed to approach the Registrar Company by way of filing a representation along with the copy of this order within a week from today. After receiving the said representation, the Registrar Company is directed to take necessary action in accordance with his affidavit and as per Paragraph 7(i), and thereafter, pass a reasoned order, after giving an opportunity of personal hearing to the petitioners/ representatives in accordance with law, expeditiously, preferably within four weeks."

Further, in view of the prayer made on behalf of the petitioners, and no objection on behalf of the respondent, the same is allowed and the petitioners are directed to approach the Registrar of Company by way of filing a representation along with the copy of this order within a week from today.

Accordingly, the instant application stands disposed of in view of the aforesaid terms.
