% 06.01.2020 IA No. 18387/2019 This is an application filed by the plaintiffs seeking deletion of defendant No.2 from the array of the parties. For the reasons stated in the application, defendant No.2 is deleted from the array of the parties.

Amended memo of parties annexed along with the application is taken on record.

The application is disposed of.

I.A. 2/2020 This is an application filed by the plaintiffs and defendant No.1 (now sole defendant) under Order 23 Rule 3 read with Section 151 CPC for taking the settlement agreement dated December 13, 2019 between the plaintiffs and the defendant on record and for decreeing the suit in terms of the settlement agreement.

Learned counsel for the parties submit that the plaintiffs and the sole defendant have settled their inter se dispute in terms of the settlement agreement dated December 13, 2019. The same has been annexed with the application at pages 12-20. They state that the same be taken on record and the suit be decreed in terms of the settlement agreement dated December 13, 2019. They also state that the parties shall be bound by the settlement agreement.

The settlement agreement dated December 13, 2019 is taken on record, binding the parties. The suit is decreed in terms of the settlement agreement dated December 13, 2019, which shall form part of the decree. Decree sheet be drawn up accordingly.

In view of the fact that the parties have settled their inter se dispute outside the Court, the plaintiffs shall be entitled to return of Court fee paid under Section 16A of the Court Fee Act, 1870. The Court Fee shall be returned of the plaintiff No.2, who I have been informed shall remit the same to plaintiff No.1 in USA after taking necessary approvals from the authorities concerned.

The dates of 08th January and 17th February, 2020 stand cancelled. V. KAMESWAR RAO, J.
