By way of present petition, the petitioner seeks setting aside of the order dated 08.01.2024 passed by the learned MM, South District, Saket, Delhi and seeks directions that the petitioner's application filed under Section 12 read with Section 23 of PWDV Act pending before the Mahila Court, South which is now listed on 09.02.2023 be considered and decided on that date.

A perusal of the order dated 08.01.2024 reveals that the petitioner's early hearing application was dismissed noting the facts stated therein. The application is now listed on 09.02.2024. The petitioner is stated to be 81 years of age.

In view of the aforesaid, the concerned Court is requested to ensure that the petitioner's application be taken up for consideration on the said date on merits without being influenced in any manner with the observations made at the time of disposal of early hearing application. 4.
