This is a petition under Section 528 BNSS, with the following prayer:- "(a) to direct the respondent no.4 to start a fresh investigation in the case FIR No.1474/2021 u/s 306/34 I.P.C; registered at Police station Mangol Puri (b) To transfer the investigation of case FIR No.1474/2021 u/s 306/ 34 I.P.C some police station in some other district through some senior high rank police officer.

(c) Pass any other order which this Hon'ble court deems fit and proper in favour of the petitioner."

The learned APP, at the very outset, submits that investigation is complete; charge sheet has already been filed and accused persons have been kept in Column No. 12 of the charge sheet. request was made by the petitioner to transfer the investigation of case FIR No 14741/2021, under Section 306/34 IPC, registered at PS Mangol Puri to some other police station in some other district through some high ranked police official and the Court had disposed of the petition with direction to the petitioner to raise his contentions before the concerned authority. 3.

At this stage, Mr. Arpit Bhalla, Advocate, who appears for the petitioner, seeks permission to withdraw the petition with liberty to make fresh request for transfer of the investigation, in case his request for further investigation/re-investigation is accepted by the trial court. 4.

The statement made by the learned counsel is taken on record and the petition is dismissed as withdrawn with liberty as prayed for. However, it is clarified that if and when such a request for investigation/re-investigation is made by the petitioner before the trial court, the same shall be dealt and decided independently on its own merits.
