The present petition has been filed under Section 439 Cr.P.C. read with Section 482 Cr.P.C. seeking interim bail in connection with FIR No. 100/2022 under Sections 302/201/34 IPC registered at Police Station Sector 23, Dwarka on the ground that the petitioner‟s wife has to undergo a surgery for gall bladder stone.

Vide order dated 23.01.2024, notice was issued to the State with a direction to verify the medical record attached with the application. The Status Report has been filed, the same is on record. 3.

A perusal of the Status Report shows that the medical documents have been verified and the petitioner‟s wife has been found suffering from Bulky Uterus and stone in gall bladder and her operation is scheduled for 08.02.2024.

The learned counsel for the petitioner also submits that no further extension for the interim bail will be sought on the same ground. 5.

Considering the aforesaid circumstances in entirety, this Court is of the view that the petitioner has made out a case for grant of interim bail. Accordingly, the petitioner is enlarged on interim bail for a period of two weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs. 20,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall not leave the Delhi without prior permission of the Court.

b) Petitioner shall appear before the Court as and when the matter is taken up for hearing.

c) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

d) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. 6.

Upon expiry of period of two weeks as stated above, the petitioner shall surrender before the Jail Superintendent. 7.

The petition stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
