Counsel for the appellant, on instructions, made a motion for withdrawal of the present proceedings as he has a remedy of participating in the execution proceedings initiated by the respondent. 2.
That being so, we deem it appropriate to dispose of the present appeal by observing the liberty in favour of the appellant as prayed hereinabove. 3.
In case, if the appellant participates in the execution proceedings through an objection, his rights be considered by the Executing Court in accordance with the scheme of Order XXI of the Code of Civil Procedure, 1908, without being influenced by the withdrawal of the present appeal.
