Criminal Writ Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (old under Section 482 of the Code of Criminal Procedure, 1973) (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing of FIR No.164/2023 under Section 365/341 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Palam Village, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

New Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement dated 23.12.2024.

On advance Notice, learned APP for the State has appeared and accepts the Notice on behalf of the State.

Briefly stated, the Complainant was going on his motorcycle on which the Petitioners had taken a lift. Due to some misunderstanding, the Complainant had informed his employer that even though, he is not intending to go to Murthal where the Petitioners intended to go for lunch but they still continuing to drag the motorcycle towards the Murthal. However, it was purely on account of misunderstanding. 7.

On the Complaint of the Respondent No.2/Complainant, FIR No.164/2023 under Section 365/341 IPC, got registered at Police Station Palam Village, New Delhi.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Compromise Deed dated 23.12.2024. In the Settlement, it was inter alia settled between the parties that the Petitioners shall pay a sum of 80,000/- towards full and final settlement of all the claims qua the Respondent.

Today, the Respondent No. 2, who is present in the Court, states that he has received all amounts due to him and has no objection if the FIR is quashed.

The Statement of the parties have already been recorded before the learned Joint Registrar.
