CRL.M.A. 10512/2023 (delay in filing) 1.

By way of present application, the petitioner seeks condonation of delay of 89 days in refiling the petition.

Issue notice.

Learned APP for the State as well as learned counsel for respondent Nos.2 to 6 accept notice.

For the reasons stated in the application, the same is allowed and the delay of 89 days in refiling the petition is condoned. 5.

The application is disposed of.

CRL.M.C. 2796/2023 1.

The present petition has been filed seeking quashing of FIR No.206/2016 registered under Sections 308/323/34 IPC at P.S. Vasant Kunj, New Delhi on the ground that the parties have amicably settled their disputes.

As per the allegations levelled in the FIR, the petitioners caused several injuries to the respondents by striking them with wooden sticks. 3.

Learned APP for the State submits that in the present case the petitioners are the only accused persons and respondent Nos.2 to 6 are the complainants/victims. He further submits that the parties are related to each other.

Learned counsels for the parties submit that the parties have entered into a settlement on 19.02.2020, before Delhi Mediation Centre, Patiala House Court, New Delhi and modified the terms of the aforementioned settlement vide order dated 25.04.2022, a copy whereof has been placed on record. In terms of the settlement, respondent No.2 is now left with no claim or grievance whatsoever against the petitioners. 5.

The petitioners and respondent Nos.2 to 4, who are present in the Court and respondent Nos.5 and 6, who have joined the proceedings through V.C., have been identified by their respective counsels as well as by the Investigating Officer.

The petitioners have shown remorse for their conduct and they undertake not to repeat the same in future. Respondent Nos.2 to 6 state that they have entered into the aforesaid mediation settlement out of their own free will, volition and without any coercion. Learned counsels for the parties submit that there is another connected FIR being FIR No.210/2016 registered under Sections 451/354/354A/354B/34 IPC at P.S. Vasant Kunj (North), Delhi, which has also been quashed vide today's order passed in CRL.M.C. 6560/2024. 8.

The parties shall remain bound by the statements made in Court today.

9. Learned counsel for the petitioners submits that no other proceedings are pending between the parties.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.
