% 26.03.2019 This petition is filed for direction to the respondents for compliance of the notification dated 11.12.2014 issued by the Lieutenant Governor of Delhi. The said notification is as under : [TO BE PUBLISHED IN DELHI GAZETTE PART- IV EXTRA -ORDINARY] GOVERNMENT OF NATIONAL CAPITAL TERRITORY OF DELHI (TRANSPORT DEPARTMENT) 5/9,UNDER HILL ROAD,DELHI-54.
No.F.DC/ARU/TPT/245/2014/PART-II/269 Dated the 11th December, 2014 NOTIFICATION No.F. DC/ARU/TPT/245/2014/PART-II/269 -In exercise of tine powers conferred by section 115 of the Motor Vehicles Act, 1988 (Act 59 of 1988), the Lieutenant Governor of the National Capital Territory of Delhi on being satisfied that it is necessary in the interest of public safety and convenience of general public of National Capital Territory of Delhi to regulate the movement of E-Rickshaws on Delhi/New Delhi roads, hereby prohibits the plying and idle parking of E-Rickshaws on the roads mentioned in the Schedule annexed to this notification.
By order and in the name of the Lieutenant Governor of the National Capital Territory of Delhi, Sd/- Secretary-cum-Commissioner (Transport) It is submitted by learned counsel appearing on behalf of the respondents that they are already taking enforcement action in terms of the notification and uptill 10th March, 2019, a total of 43528 challans were issued for idle parking of the E-rickshaws and a total of 1433 illegal E-Rickshaws were impounded. It is stated Delhi Police is meticulously implementing the directions as contained in the notification in true letter and spirit and shall continue to do the same. Hence there is nothing more which can be done in the present writ petition. The same is disposed of considering the submissions so made by learned counsel for the respondents.
