CRL.M.C. 405/2025 3.
By way of present petition, the petitioners are seeking quashing of FIR bearing No. 228/2024, registered at Police Station Jafrabad, Delhi for the offence punishable under Sections 135/138/150 of the Indian Electricity Act, 2003 and all consequential proceedings arising therefrom. 4.
Issue notice. The learned APP accepts notice on behalf of the State and the learned counsel accepts notice on behalf of respondent no. 2. 5.
Brief facts of the case are that due to some misunderstanding between the petitioners and respondent no. 2, a complaint was lodged by respondent no. 2 which resulted into registration of the present FIR. was filed before the concerned Trial Court. Thereafter, with sincere efforts of the parties, they have resolved and settled their all disputes with each other before the Special Lok Adalat and the entire payment has been received by respondent no. 2 and a 'no dues' certificate was issued by respondent no. 2.
6.
Considering the same, both the petitioners are present and have been identified by their counsels and Investigating Officer concerned. 7.
The learned counsel for respondent no. 2/complainant states that he has no objection, if the present FIR is quashed. 8.
In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, this Court is of the opinion that no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question. 9.
Accordingly, FIR bearing No. 228/2024, registered at Police Station Jafrabad, Delhi for the offence punishable under Sections 135/138/150 of the Indian Electricity Act, 2003 and all consequential proceedings emanating therefrom are quashed.
10.
In view of above, the present petition stands disposed of. 11.
