This appeal was sent for settlement by mediation vide order dated 30.8.2011.

On record there is a written settlement agreement dated 11.11.2011 signed by the parties as also the mediator. By the settlement agreement dated 11.11.2011, disputes were settled as stated in the settlement agreement.

In view of the above, the appeal is disposed of in terms of the settlement agreement dated 11.11.2011 and which satisfies the requirements of Order 23 Rule 3 of Code of Civil Procedure, 1908 (CPC) as the settlement agreement is in writing signed by the parties containing the terms of the settlement.
