Learned counsel for the petitioner after arguing for some time and in view of the decision of the Five Judge Bench of this court in Sterling Agro Industries Ltd. v. Union of India 2011 SCC OnLine Del 3162 wherein it was held that the Appellate Authority being situated within the jurisdiction of the High Court shall not be the sole factor to decide the matter on merits, on instructions from the client present in court, seeks permission to withdraw the writ petition with liberty to approach the appropriate forum. 2.

The writ petition is dismissed as withdrawn with liberty as prayed for. 3.

Pending application is also disposed of.
