% 08.01.2020 On 01.04.2019 notice was issued to the respondent returnable on 04.09.2019. The appellant was further directed to deposit 2/3rd of the decretal amount within four weeks and hence the impugned judgment was stayed. The office note says the said amount has not been deposited. On 04.09.2019, the PF filed was under objection and notice could not be served. Yet again the appellant was directed to serve the respondents by all modes for today. Till today no PF has been filed. Even none appears for the appellant today. It seems the appellant is not interested in pursuing the appeal. In the circumstances, the appeal is dismissed in default and for nonprosecution. Pending application is also dismissed as infructuous. YOGESH KHANNA, J.
