% 22.01.2026 CRL.M.A. 2353/2026 (exemption) Exemption granted, subject to just exceptions. The application stands disposed-of.

W.P.(CRL) 243/2026 By way of the present writ petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners seek quashing of case FIR No.624/2023 dated 16.10.2023 registered under sections 420/34 of the Indian Penal Code 1860 ('IPC') at P.S.: Dwarka North, Delhi. 2.

The matter arises from the allegation that petitioner No.1 had taken a loan from respondent No.2 based on misrepresentations. 3.

The parties are stated to have settled the matter; and a letter dated 22.12.2023 evidencing settlement of the loan account has been issued W.P.(CRL) 243/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. by respondent No.2.The authorized representative of respondent No.2 is present in court. He confirms the issuance of the letter. 4.

Since petitioner No.1 is a partnership firm, the petition is supported by affidavits of petitioners Nos.2 and 3 (who are partners of the said partnership firm); and of the authorized representative of respondent No. 2, alongwith proof of their IDs.

There appears to be no larger public aspect to the offence. 6.

Mr. Rahul Tyagi, learned ASC confirms that the State has no objection to the subject FIR being quashed 7.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties. 8.

Accordingly case FIR No.624/2023 dated 16.10.2023 registered under sections 420/34 of the IPC at P.S.: Dwarka North, Delhi is quashed. All proceedings arising therefrom also stand closed. 9.

Petition stands disposed-of.
