The present appeal under Clause X of Letters Patent seeks to assail the judgment dated 15.12.2023 passed by the learned Single Judge in W.P.(C) 44/2021. Vide the impugned judgment the learned Single Judge has dismissed the writ petition preferred by the appellant. 2.

After some arguments, learned counsel for the appellant seeks leave to withdraw the present appeal with liberty to file a fresh appeal. 3.

The appeal is, accordingly, dismissed as withdrawn along with all pending application, with liberty as prayed for.
