None appears for the petitioners.

It is noted that since 17.05.2023, the matter has been listed on three occasions. Neither the petitioners nor their counsel has appeared. Even today, the petitioners remain unrepresented and even no notice has been issued in the instant petition till date.

I have gone through the contents of the petition which has been filed seeking setting aside of the orders dated 21.12.2015 and 29.06.2018 passed by the learned MM. By the impugned order, the cognizance of the offence was taken and summons were issued to the accused persons. By the latter order, only notice on an application under Section 431 read with Section 421 Cr.P.C and under Section 2 (b) of the Contempt of Courts Act was issued by the learned Trial Court.

The petition is premised on the ground that no specific name of the accused persons was mentioned in the summoning order and that petitioner Nos. 3 and 4 were not part of the mediation process. 5.

the present petitioners were impleaded as accused Nos.2, 4 and 5. The ground taken in support of the petition would not bring it within the parameters of exercise of powers under Section 482 Cr.PC and the same would require trial.

In view of the above, I am not inclined to entertain the present petition and the same accordingly dismissed along with pending applications.
