% 06.01.2020 Petitioner is seeking a direction to the SHO of police station Okhla Vihar Metro Station to conduct fair investigation regarding death of SI Late Bhagat Singh.

Learned counsel appearing on behalf of respondent/State submits that petitioner‟s application under Section 156 (3) Cr.P.C. is pending consideration before the learned Metropolitan Magistrate (Court Room No. 510, District Saket, New Delhi) and petitioner can urge the pleas taken herein before the said court.

Learned counsel for petitioner submits that petitioner‟s application under Section 156 (3) Cr.P.C. stands already dismissed and after taking W.P.(CRL) 1012/2019

cognizance, statement of witnesses under Section 200 Cr.P.C. is being recorded.

Heard.

After hearing learned counsel representing both the sides, this Court is of the opinion that alternate and efficacious remedies are available to the petitioner. He can challenge the dismissal of his application under Section 156 (3) Cr.P.C. in revision. In view of aforesaid, this petition and application are disposed of with liberty to the petitioner to approach this Court after exhausting the remedies available to him as per law.
