The present petition seeks that the learned ATMCD be directed to decide, at the first instance, the stay application preferred by the petitioner in appeal bearing no.ATMCD/16/2024 tiled as "Satbir Singh Sehwag vs. Municipal Corporation of Delhi" pending before learned ATMCD. 2.

Admittedly, the aforesaid appeal came up for hearing before the ATMCD on 12.01.2024, on which date, notice was issued in the appeal and the application. Thereafter, the matter was adjourned to 19.01.2024. On 19.01.2024, the matter was adjourned to 29.01.2024. already seized of the matter, this Court is not inclined to pass any preemptive order/s on the stay application of the petitioner. 3.

Accordingly, the present writ petition is dismissed. However, the petitioner is granted liberty to file appropriate application and press for stay/interim relief before the ATMCD which shall be considered by ATMCD in accordance with law. If and when the petitioner approaches the ATMCD in this regard, the ATMCD is requested to consider the same expeditiously and pass the appropriate order/s. 4.

It is made clear that this Court has not expressed any opinion on the merits of the contentions raised in the present petition.
