Mr. Sameer Nandwani, counsel for appellant/Insurance Company states that this appeal has been filed for setting aside judgment dated 11th November 2025 passed by Motor Accidents Claims Tribunal ['MACT'], District Shahdara, Karkardooma Courts in MACT No.683/2022; however considering the provisions of Section 173(2) of Motor Vehicles Act, 1988, such appeal may not be maintainable on the ground of the award being less than Rs.1,00,000/-.

However, he pleads that a connected appeal being MAC.APP. 24/2026, against other claimants arising out of the same accident, is pending before the Court. Also that issues raised in this appeal may be kept open for him to take the said pleas in the connected appeal. 3.

Accordingly, the present appeal stands dismissed. 4.
