BAIL APPLN. 2765/2019 Vide the present petition, the petitioner seeks bail in FIR No. 390/2019 registered at Police Station Swaroop Nagar, Outer North Delhi District.
During arguments, learned counsel for the applicant submits that due to unfortunate accident two auto drivers have lost their lives and he is ready to contribute as compensation for an amount of ₹5 lacs to be paid in favour of the family of the victims.
The petitioner is in judicial custody since 16.09.2019. Keeping in view the fact that chargesheet has been filed and trial shall take substantial time and the fact that the petitioner has come forward to pay an amount of ₹5 lacs for the welfare of the victims' family and said amount is being paid without raising any issue in any of the proceedings qua family of the victims.
Accordingly, I hereby direct the trial Court to admit the petitioner on bail on his furnishing personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the Trial Court on deposit of ₹ 5 lacs. Accordingly, the petitioner is directed to deposit an amount of ₹2.5 lacs each in favour of the widows of the victims before the Trial Court by way of demand draft and the Trial Court shall hand over the said amount to the widows of the victims.
Application stands allowed and disposed of.
Copy of this order be transmitted to the Jail Superintendent and the Trial Court concerned for compliance.
