The present petition under Section 25-B (8) of the DRC Act seeks the following prayers:- "a) Call the record of Eviction Petition in Case No:- RC ARC:- 54/2017, titled as Kishan Chand Goel (Through Legal Heirs VS Anil Aneja; and/or b) Call the record of Eviction Petition in Case No:- E/12/13, titled as Kishan Chand Goel Vs Anil Aneja c) Allow the rev1s10n petition of the Petitioner and set aside the impugned order dated 31.08.2024, passed by Ms. Anuradha Jindal, Ld. ACJ-CCJ-ARC, South West District, Dwarka Courts, New Delhi in Case No:- RC ARC:- 54/2017, titled as Kishan Chand Goel (Through Legal Heirs VS Anil Aneja; and/or d) Award cost of the proceedings throughout; and/or Any other or further directions as deemed appropriate by this Hon 'ble court may also be passed."

Settlement and vide order dated 18.12.2025, the learned Predecessor Bench of this Court, while recording the same had directed the petitioner to file an affidavit of undertaking.

The affidavit of undertaking dated 02.01.2025 by the petitioner has been filed, which records as under:- "3. That the deponent shall hand over the vacant, peaceful and physical possession of the subject premises to the Respondent/ landlord on or before 26.01.2026.
4. That the deponent shall clear all electricity, water and all other statutory dues qua the subject premises, and hand over all the requisite documents reflecting the payment(s) of each of the above to the Respondent/landlord on or before the said date, i.e. 26.01.2026."

The affidavit of undertaking is taken on record. 6.
In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition. The same is dismissed as withdrawn and disposed of accordingly.
