Learned counsel for the respondent, at the outset, submits that he would be satisfied if the respondent is reasonably compensated and the petitioner, in case succeeds, is not awarded any interest for the period which has been spent in pursuing the present petition.

Learned counsel for the petitioner, on instructions, submits that in case the complaint filed by the petitioner is allowed, petitioner will not claim any interest for the period upto passing of the present order.

In view of the above, without going into the merits of the case and without going into the maintainability of the present petition, the complaint filed by the petitioner under Section 138 of the Negotiable Instruments Act bearing Criminal Complaint No.518038/2016 is restored to its original number before the concerned learned Metropolitan Magistrate ('MM'). 4.

The parties are directed to appear before the concerned MM on 04.10.2024, on the petitioner paying a cost of ₹50,000/-, in addition to the cost of ₹10,000/- as imposed by this Court by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
