O R D E R

The present petition alleges wilful disobedience / non-compliance of the directions contained in the order dated 19.01.2026, passed in OMP (I) (COMM.) 20/2026. The said order reads as under: "1. The present Petition, under Section 9 of the Arbitration and Conciliation Act, 1996 ("Act"), seeks the following reliefs: "A. Pass an order restraining the Respondent, its officers, agents and representatives from giving effect to, acting upon or in furtherance of the Show Cause Notice dated 19.11.2025, including from levying or recovering any compensation under Clause 2 of the General Conditions of Contract, pending resolution of disputes; and/or, B.

Pass an order restraining the Respondent from any coercive action but not limited to invoking, encashing or otherwise acting upon the Bank Guarantee(s) furnished by the Petitioner in relation to the subject contract, till the disputes are adjudicated as per clause 25 of the Contract; and/or, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

C. Pass an order directing the Respondent to maintain status quo with respect to the subject contract, including refraining from taking any coercive or prejudicial steps against the Petitioner pursuant to the Show Cause Notice dated 19.11.2025; and/or, D. Pass such further or other interim orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice."

2. Learned counsel for the Respondent, at the outset, states that in the present case, notice under Section 21 of the Act has not been issued by the Petitioner herein.

3. On instructions, he further submits that no coercive steps will be taken against the Petitioner, prior to crystallization of the compensation amount by the Respondent authority.

4. In view of the aforesaid submissions and consent of the parties, the present Petition stands disposed of, along with pending application(s), if any, while recording the submission of the learned counsel for the Respondent." 2.

Learned counsel for the respondent, who appears on advance notice submits that the respondent shall scrupulously comply with the directions contained in the said order. He points out that a communication has been addressed by the respondent to its bank seeking to withdraw a communication dated 18.01.2026 whereby certain bank guarantees furnished by the petitioner were sought to be invoked.

The aforesaid statement of learned counsel for the respondent is taken on record.

In view thereof, no further orders are required to be passed in the present petition. The same is accordingly, disposed of. 5.

Pending application also stands disposed of.
