Heard the learned counsel representing the respective parties. 4.

An affidavit on behalf of respondent No.1 in compliance of the order dated 22nd January, 2025 passed by the Court, has been handed over today in Court and the same is taken on record, wherein it has been stated, inter alia, that as per the result of evaluation to the financial proposal, the petitioner would not have emerged as a successful bidder for the two locations, i.e. Nepai and Navalpur-Dharera in respect of which the tenders were submitted The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. by the petitioner.

The said averments have been made in para 4 of the affidavit which is extracted herein below:- 4.

That the Financial Proposal of the technically responsive/qualified bidders was thus opened by the Respondent No. 1 on 21.01.2025. That as per the result of the evaluation of the Financial Proposal, the highest bidders were declared H-1. It is pertinent to submit that the Petitioner had submitted its bid for two locations i.e. Nepai and Navalpur-Dharera. That even if the bid of the Petitioner was declared as 'responsive', as per the evaluation of the Technical Proposals, the Petitioner would not have emerged as the successful bidder for both locations i.e. Nepai and Navalpur-Dharera. That the bid submitted by the Petitioner for Nepai location was INR.31,11,000 whereas the H-1 bidder has bid INR.77,77,777/-. That the bid submitted by the Petitioner for NavalpurDharera was INR. 12,11,000/-, whereas the H-1 bidder has bid INR. 75,60,000/-. True copy of the Financial Proposal dated 01.08.2024 submitted by the Petitioner is annexed herewith and marked as Annexure R1/2.

In view of the aforesaid, nothing needs to be adjudicated any further in this writ petition which is hereby disposed of.
