The present petition under Article 226 of the Constitution of India read with Section 482 of the CrPC seeks following prayers:- "In light of the above mentioned facts and circumstances, it is most respectfully prayed that, this Hon'ble Court may be pleased to:- a) Issue a writ in the nature of Mandamus directing the respondent to release the petitioner on furlough for a period of three (3) weeks in FIR No. 139/2004, U/S 302/186/201/392/120B/34 IPC, P.S. Mangolpuri & FIR No.119/2004, U/S 25/54/59 Arms Act, P.S. Shalimar Bagh: b) Pass such further order(s) as this Hon'ble Court deems fit and proper." 2.

Learned Additional Standing Counsel for the State, who is appearing on advance notice, submits that the application of the present petitioner for grant of furlough has been dismissed by the competent authority on 25.01.2024.

In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petitioner with liberty to file a fresh petition challenging the aforesaid order.
