O R D E R

% 23.04.2026 1.

The present writ petition is filed by the Petitioner with the following prayers:

"1. Issue a writ of mandamus or any other appropriate writ, order or direction, thereby directing the respondents to upgrade the petitioner to the post of HC/Paramedic to ASI (Pharmacists) in terms of the communication dated 15.06.2018 issued by the DG NDRF, DATED 02.07.2019 issued by the MINISTRY OF HOME AFFAIRS, and DTAED 16.08.2023 issued by the :MINISTRY OF HOME AFFAIRS also and counter-affidavit filed by the respondents before this Hon'ble Court on 20.09.2024 in W.P (C): 15636/2023 titled as SONIA JAKHAR & ORS vs. UNION OF INDIA & ORS in time bound manner.

2. Pass any other order, this Court deems fit in the interest of Justice."

On 08.12.2025, the following order was passed: "1. As the question of upgradation of the post of Head Constable/Paramedics to ASI/Pharmacist has been forwarded by the Ministry of Home Affairs1 to Ministry of Finance in April 2025, and is pending with the Ministry of Finance since then. We would seek response from the Ministry of Finance as to the status of the proposal.

2. In that view of the matter, we direct Mr. Abhay Kumar Bhargava, learned Counsel for the petitioner to implead the Ministry of Finance as Respondent 4.

3. Let an amended memo of parties be placed on record within a week from today.

4. Ms. Niyati Sharma, learned SPC accepts notice on behalf of the Ministry of Finance as well.

5. She is requested to ascertain from the Ministry of Finance as to the status of the proposal which has been forwarded to them in April 2025 by the MHA for upgradation of the post of Head Constable/Paramedics to ASI/Pharmacist.

6. Renotify on 22 December 2025 for disposal in the Supplementary List."

Thereafter, on 22.12.2025, the following order was passed: "1. Ms. Niyati Sharma, learned Counsel for the respondents submits that the Ministry of Finance has sought three months' time to look into the proposal forwarded by the Ministry of Home Affairs for upgradation of the post of Head Constable (Paramedic) to Assistant Sub Inspector, as it involves substantial budgetary issues.

2. Accordingly, renotify on 23 April 2026 in the Supplementary List."

Today, the learned counsel representing the Respondents has produced a letter dated 08.04.2026, sent by Ministry of Home Affairs (Disaster Management Division), Government of India to National Disaster Response Force, disclosing that any change in composition and pay scale will require Cabinet Approval.

Keeping in view the aforesaid position, the writ petition stands disposed of by directing the Respondents to take the final decision expeditiously.
