This writ petition is preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(a) Issue an appropriate writ, order or direction to the Respondent No.1 to 4 for dismantling and demolishing all the unauthorised and illegal construction existing inside and outside of the property bearing No. 565, West Guru Angad Nagar, Gali No.2, Laxmi Nagar, Delhi -110092. (b) Issue an appropriate writ, order or direction to Respondent No.5 thereby restraining from raising any illegal, unlawful and unauthorised construction at the property and further not to allow anyone to raise any type of construction in any manner.

(c) May kindly impose costs upon the Respondent No.1-4 for wilfully and knowingly disobeying! disregarding the statutory provisions of the Act." 4.
Issue notice.

Counsels, as above, accept notice on behalf of the respective Respondents.

Learned counsel for Municipal Corporation of Delhi (MCD), appearing on advance copy of the writ petition, on instructions, submits that the subject property bearing no. 565, West Guru Angad Nagar, Gali No.2, Laxmi Nagar, Delhi has been booked on 17.01.2025 and Work Stop Notice was issued on 21.01.2025 and further action will be taken in accordance with law and keeping in view the guidelines of the Supreme Court in In Re: Directions in the matter of demolition of structures, 2024 SCC OnLine SC 3291. Documents handed over by learned counsel for the MCD are taken on record.

Accordingly, this writ petition is disposed of taking the stand of the MCD on record. Needless to state that MCD will take further action after compliance with the statutory formalities and keeping in view the judgment of the Supreme Court in In Re: Directions in the matter of demolition of structures (supra).

This order is passed without prejudice to the rights and contentions of Respondent No. 5, who may resort to legal remedies in case of any grievance.
