This petition has been filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following relief:- "a; Issue a writ of mandamus or any other similar writ, order or directions to respondent No. 4 for disbursing the compensation amount to the petitioner in respect of the property bearing no L- 106 measuring 100 sq. yd part of Khasra No 5 Situated in the area of village Tajpur Colony known as Defense Enclave New Delhi- 110071 Delhi:" 2.

Pursuant to order dated 03.08.2023 of this Court, copy of an award bearing No. 04/2008-09 has been placed on record by the Petitioner. There seems to be some confusion in the petition with respect to the award whereby the land of the Petitioner was acquired. Delhi Development Authority (DDA) has not been impleaded as a party in the present case. Learned counsel for Respondent No. 3 states that National Highways Authority of India (NHAI) acquired land from DDA only after the road was officially designated as a National Highway. 3.

Learned counsel appearing on behalf of the Petitioner, on instructions, seeks to withdraw the petition with liberty to file a fresh petition with better and complete particulars including the correct number of award and a copy thereof.

Petition is disposed of as withdrawn with liberty as prayed for, in accordance with law.
