CRL.M.A. 5053/2025 (Modification of Judgment dt. 29.01.2025) 3.

The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter 'BNSS') has been filed on behalf of the applicant, seeking modification of the judgment dated 29.01.2025, by which the applicant herein was granted furlough for a period of three weeks on furnishing a personal bond in a sum of Rs. 10,000/- with one surety of the like amount, to the satisfaction of the Jail Superintendent. 4.

the applicant herein is unable to furnish his surety and, therefore, he be permitted to furnish cash surety. The learned counsel further states that the petitioner has not misused the liberty granted to him on several occasions. 5.

This Court's attention has been drawn to the order dated 27.09.2023 passed by the competent authority (Annexure P-2), wherein the applicant was permitted to furnish cash surety of Rs. 10,000/- alongwith a personal bond in the like amount to the satisfaction of the Jail Superintendent. 6.

After hearing submissions made on behalf of the petitioner and going through the judgment passed by this Court on 29.01.2025, this Court is inclined to allow the present application. The petitioner is permitted to furnish a cash surety of Rs. 10,000/- alongwith a personal bond in the like amount, as mentioned in the judgment dated 29.01.2025. 7.

It is clarified that the other conditions imposed on the petitioner will remain the same.

In view of above, the present application stands disposed of. 9.
