CORAM:

HON'BLE MR. JUSTICE R.K.GAUBA

% 09.01.2018 CM No. 778/2018(exemption) Allowed subject to all just exceptions.

C.R.P.7/2018 & CM No. 779/2018(stay) & CM No. 777/2018(delay) The counsel for the petitioner submits that he may be allowed to withdraw the petition as he would instead like to move the trial Court with request for issuance of Commission for examination of the witness in question.

It is pointed out that by the impugned order dated 21.11.2017, the learned trial Judge had granted 45 days time to the petitioner to secure the presence of the witness who is located overseas. Since the C.R.P. 7/2018

petitioner intends to move an application for issuance of commission for examination of the said witness, the learned trial Court will consider grant of extension of time accordingly. The petition and the applications are dismissed as withdrawn. Dasti under the signature of Court Master.
