Learned counsel for the petitioner submits that an application under Order XXI Rule 46 read with Rule 46A read with Section 151 CPC was moved before the learned Trial Court which has not been considered and disposed of by the learned Trial Court.

Learned counsel for the respondent submits that the said application was not pressed by the learned counsel for the petitioner herein before the learned Trial Court rather some time was requested in this regard, however, learned counsel for the petitioner disputes the same. 3.
In view of the above, the learned Trial Court is directed to hear and consider the aforementioned application on the date fixed before it i.e., 01.03.2024.
