A Petition under Section 528 BNSS has been filed on behalf of the Petitioners seeking quashing of the FIR No.158/2024 under Section 308/34 registered at Police Station Prasad Nagar, Delhi.

The complaint had been filed by the respondent No. 2/injured against the Petitioners vide FIR No. 158/2024 U/s 308/34 IPC. 5.

The complainant/Respondent No.2 is present in the Court and on query Respondent No.2 and 3, the injured have submitted that they all are known to each other and are the drivers. They had consumed liquor and an altercation took place between them in which both the injured got a blow on their head with a danda. The injuries of Monu have been certified as 'Simple' and that of Surya has been certified as 'Grievous', but as per the MLC the suturing of his lacerated wound on the head was done. There is nothing to reflect that Surya had suffered Grievous injuries. 6.

It is submitted that both the petitioners and respondent No. 2 and 3 have already sorted out their all differences with the intervention of their respective persons The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. of the vicinity in terms of the Compromise Deed dated 17.01.2025 inter-se the parties and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed. 7.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. The statements of the parties have been recorded by the learned Joint Registrar. The Petitioners undertake to remain bound by their Statements made before the learned Joint Registrar and also in terms of the Compromise Deed dated 17.01.2025, which has been arrived at voluntarily between them.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 158/2024 registered at Police Station Prasad Nagar, for offences punishable under Sections 308/34 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua all the accused persons/petitioners.
