The present writ petition has been filed seeking a direction to the respondent no. 1/ MCD to take demolition action against the illegal and unauthorized construction raised at the property bearing no. 65/79, New Rohtak Road, Karol Bagh, New Delhi-110005, which is adjacent to the property of the petitioner.

It is stated that the aforesaid construction is being carried out without any sanction plan.

Mr. Dutta, counsel appearing on behalf of the respondent no.1/MCD, on advance notice, submits that the contention of the petitioner that the construction in the aforesaid property is going on, without any sanction plan is completely erroneous.

He has shown to the Court the sanction letter dated 28th March, 2025. 4.1.

In view thereof, there is no merit in the present petition. 6.

The present petition along with all pending application(s) stands dismissed in terms of above.

Needless to state that in the event, the construction is carried out in violation of the sanction letter, appropriate action in accordance with law shall be taken by MCD.
