CRL.M.C. 584/2024 Petition under Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner with the following prayers:
"a) Direct the Respondent to decide/dispose of the CC No.1251/2021 under N1 Act titled as Rajnish Tiwari v/s Nilesh Devendra Vora pending before the Ld. MM, (NI Act) digital Court East, Karkardooma Courts, Delhi, in time bound manner."
At the outset, it may be observed that the petitioner has failed to implead accused as a respondent in the present proceedings, which relate to Section 138 of Negotiable Instruments Act, 1881. Since, the dates appear to have been fixed by the Trial Court in accordance with the Board and pendency of cases, no grounds are made out to direct the learned Metropolitan Magistrate to give priority to the petitioner over other cases pending in the Court as prayed by learned counsel for petitioner.
However, learned Trial Court may make an endeavour to expedite the proceedings, in accordance with law.
The petition is accordingly disposed of.
A copy of this order be forwarded to learned Trial Court for information and compliance.
