None appears on behalf of petitioner.

It is noticed that on last two dates i.e. 12.11.2024 and 15.10.2024 also, there was no appearance from the side of petitioner and adverse orders were deferred.

The present petition has been filed by plaintiff, who is aggrieved by the unconditional grant of leave to defend to his adversary. 4.

Learned counsel for respondent submits that the case is at the stage of final arguments and is now fixed for 15.04.2025. 5.

Non-appearance of anyone from the side of petitioner on previous two days and today as well goes on to suggest that perhaps petitioner (plaintiff) has lost interest in pursuing with the present petition. 6.

Resultantly, the petition stands dismissed-in-default and for non-prosecution.
