Third Petition under Section 483 BNSS has been filed on behalf of the Applicant for grant of regular bail in FIR No.582/2017, under Section 21 NDPS Act and Section 33, 38 Excise Act, P.S.Jahangirpuri.

It is submitted that the Petitioner was admitted to regular bail in this FIR vide Order dated 19.05.2018. Charges in the present case were framed on 22.03.2019. Thereafter, she failed to appear in the Court on 20.12.2023 and the NBWs were issued by the Trial Court. It is submitted that the Applicant was implicated in another FIR bearing No.324/2023 in which she was declared a Proclaimed Offender and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. was eventually arrested on 20.02.2024 and thereafter produced in this case before the learned Trial Court on 21.02.2024. Since she was declared a Proclaimed Offender in another case she was unable to appear in this Case. Hence, Bail is sought.

Learned APP has opposed the Application on the ground that the Applicant has been involved in more than 17 cases. The condition of granting bail in 2018 was that she would not commit the offence while on bail despite which that bail condition has been violated as she committed similar offence for which FIR has been registered. 4.
Looking at her past antecedents of having an involvement in more than 17 cases of similar nature, she does not deserve any benefit of bail.

Considering that she has been earlier granted bail and was unable to appear in this case because of her involvement in another case and being declared a Proclaimed Offender in the said case and also considering that she is a women, she is admitted to bail in the sum of Rs.25,000/- with one surety of the like amount on the conditions on which she was earlier released on bail with an additional condition that in case she gets involved in any other case or breaches any of the conditions of the bail, the bail shall stand automatically cancelled and she would not be entitled to any further bail.
