Petitioners herein seek quashing of FIR No.16/2023 dated 18.01.2023, for commission of offences under Sections 498A/406//34 of IPC, registered at P.S. Rani Bagh. Subsequently, in the charge-sheet, offences under Sections 377/313/509 of IPC, were added.

Charge-sheet has been filed and cognizance has, reportedly, been taken by the concerned Magisterial Court.

The grievance of the petitioners is two-fold. Firstly, the order of cognizance is mechanical in nature and secondly, even if the allegations are taken as gospel truth, no offence under Section 313 and 377 IPC stands revealed.

Learned counsel for the petitioners submits that prior to the marriage in question, the complainant/prosecutrix had lodged an FIR of rape/sexual CRL.M.C. 601/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. assault but, eventually, the same was got quashed as the prosecutrix had herself filed an affidavit that her abovesaid complaint was false. 5.
After hearing arguments for some time, learned counsel for the petitioner seeks to withdraw the present petition while reserving all her rights and contentions. She submits that she may be permitted to raise all such contentions before the learned Trial Court at the time of arguments on charge and in case the learned Trial Court chooses to go ahead with the trial, she may be permitted to file the quashing petition afresh. 6.
In view of the above, the present petition is disposed of as not pressed. All rights and contentions of the parties are left open. Liberty, as prayed, is granted.
