Petitioner seeks quashing of case FIR No. 1039/2021 of PS Punjabi Bagh for offence under Section 279/338 IPC on the ground that the complainant de facto (respondent no.2) has compromised the disputes with the petitioner.

Respondent no.2, identified by Investigating Officer/SI Naresh Kumar, accepts notice.

Petitioner has handed over a demand draft of the compromised amount of Rs.1,70,000/- to respondent no.2 who accepts the same towards full and final settlement since an amount of Rs.1,62,000/- has already been received by him as compensation under the Motor Vehicles Act. The injuries suffered by respondent no.2 in the road side accident caused with the vehicle of petitioner were fracture of his left leg. 5.
I have spoken with respondent no.2 in Hindi and he submits that he does not wish to pursue trial against the petitioner as he has compromised the disputes.

Considering the above circumstances, I am satisfied that it would be in the interest of justice, not to push the parties through full dress trial. Therefore, the petition is allowed and accordingly FIR No. 1039/2021 of PS Punjabi Bagh for offence under Section 279/338 IPC as well as proceedings arising out of the same are quashed. Accompanying application stands disposed of.
