This is a petition under Article 227 of the Constitution of India filed on behalf of the petitioner for setting aside the impugned order dated 10.12.2024 passed by the learned District Judge, Patiala House Court, Delhi in RCA DJ 5282/2016 and connected appeals with directions for expeditious disposal within time frame.

It is submitted by the learned senior counsel that both petitioner and respondents appealed against the decision. It is stated that appeals are still pending since over a decade before the first appellate court. 4.

The attention of the Court has been drawn to the orders dated 16.11.2024 and 28.11.2024. It is apparent from the said orders that final arguments had been elaborately addressed before the first appellate court on 16.11.2024 and while the case was listed for further arguments, it was noticed by the first appellate court that trial court judgement specifically makes mention of point 'b' upon Ex. PW1/D9 but the said document could not be traced from the record and for seeking further clarification the matter was adjourned to 21.04.2024.

Petitioner then filed an application for preponement but the same was dismissed on account of the reason that large number of cases were pending before the court. The court did not find any urgency in the appeals pending before it, and thus dismissed the preponement application. 6.

Petitioner is stated to be an old person and a senior citizen. The appeals are pending since last more than 10 years. Administrative directions have been issued by High Court from time to time to take up old matters and the cases of senior citizens on top priority. 7.

Since the appeals have been substantially heard by the first appellate court, and taking note of the fact that these appeals are old appeals, the present petition is disposed of with the direction that these appeals be taken up on top priority and best possible endeavour be made to dispose of the appeals on or before the next date listed before the first appellate court i.e 21.04.2025. Both parties are requested to render their due cooperation to the appellate court with direction that they shall not seek any adjournment from their side for arguments on account of any reason.
