The present writ petition has been filed seeking a direction to the respondent/MCD to seal the property bearing no. 893-D, Ward no.8, Mehrauli, New Delhi-110030 in front of Multan Dharamshala (hereinafter 'subject property') and to take action against the illegal and unauthorised construction.

Counsel appearing on behalf of the petitioner submits that in gross violation of the applicable bye-laws, the private respondent no.4 has constructed five floors in addition to the basement and the stilt area. 3.

While issuing notice on 23rd January, 2026, the statement of Mr. Ashutosh Gupta, Additional Standing Counsel for the respondent/MCD, was recorded that the subject property was booked on many occasions and was also sealed. continued with the unauthorised construction. Accordingly, a direction was issued to the respondents no.1 and 2, to ensure that no further construction is carried out in the subject property.

A status report dated 20th May, 2026, has been filed by the respondent/MCD, which is not on record.

4.1.

Copy of the status report has been handed over in Court and the same is taken on record.

As per the said status report, demolition action was carried out in respect of the subject property on 9th April, 2026 and two (2) RCC panels were demolished on the roof of the 5th Floor. On 15th May, 2026, it was noted that the earlier seal affixed by MCD has been tampered with and hence, fresh sealing action took place on the said date. Photographs of the seal affixed by the respondent/MCD on 15th April, 2026, have been placed on record. It is further stated that letters dated 10th April, 2026 and 19th May, 2026 have been issued to SHO, P.S.: Mehrauli, to keep a strict watch and ward over the subject property, so that the demolished portion is not restored and the seals are not tampered with. Further demolition action is planned on 28th May, 2026.

In light of the aforesaid status report, the respondent/MCD is directed to continue with the demolition action planned on 28th May, 2026. 7.

In the status report, it has also been stated that a communication has been sent to the Police Authorities for registration of FIR on account of tampering of the seal.

Accordingly, the following directions are issued to the respondent no.3/SHO, P.S. Mehrauli, New Delhi-110030:

i.

A proper investigation/FIR shall be initiated for tampering of the seal. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

ii.

It shall be ensured that the seal in the subject property is not tampered with and no further unauthorised construction is carried out in the subject property.

iii.

Necessary Police force shall be provided to the respondent no.1/MCD for the proposed demolition action planned on 28th May, 2026. 9.

In terms of the aforesaid, the writ petition stands disposed of. 10.

In the event any further grievance arises, the petitioner shall be at liberty to avail remedies in law.

All rights, contentions and legal remedies of owner/occupier/private respondent are kept open.
