% 11.02.2020 This is a petition filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR bearing no. 0181/2019, u/s. 376/506 IPC PS Greater Kailash, Delhi.
Learned counsel for the petitioner has prayed for anticipatory bail on the ground that petitioner is innocent and has been falsely implicated. Petitioner has joined the investigation. Learned counsel for the petitioner submits that Faraz Khan, who is the younger brother of the petitioner-Sirat Khan, has been named in FIR and the main allegations have been levelled against him. As per FIR, the petitioner-Sirat Khan only used to lock the room when the prosecutrix/complainant used to go inside the house with the petitioner's younger brother-Faraz Khan.
Learned Additional Public Prosecutor for the State has opposed the bail application on the ground that the allegations against the petitioner are serious in nature.
Heard. Keeping in view the fact that petitioner has joined the investigation and main accused Faraz Khan has also been granted bail by the Ld. Trial Court and also in view of the fact that custodial investigation of the petitioner is not required, the anticipatory bail application of the petitioner is allowed. It is accordingly ordered that in the event of his arrest, the petitioner be released on bail on his furnishing personal bond in the sum of Rs. 15,000/- with one surety in the like amount subject to the satisfaction of IO/SHO concerned.
