By way of the present application, the applicant has approached this Court seeking bail, without having first availed the remedy before the learned Sessions Court. Mr. Vaibhav Tyagi, learned counsel appearing for the applicant, seeks to withdraw the present bail application, with liberty to approach the learned Sessions Court, in accordance with law. 2.

The petition is accordingly dismissed as withdrawn, with liberty as aforesaid.

It is clarified that all rights and contentions of the parties are left open to be urged before the learned Sessions Court, and this Court has not expressed any opinion on the merits of the matter.
