The petitioner retired from the services of respondent No. 1 - Indian Bank ["the Bank"] on 31.01.2022. He has filed this petition, under Article 226 of the Constitution, directed against a chargesheet dated 29.01.2022 which, according to him, was served upon him on the last date of his service, i.e. 31.01.2022.

The charges against the petitioner relate to loans granted by the Bank to certain customers, during the time the petitioner was a member of the concerned Zonal Level Credit Committee ["ZLCC"]. It is inter alia the petitioner's contention that other members of the ZLCC have either not been subjected to disciplinary proceedings, or have been subjected to minor penalty proceedings.

Mr. Akash Vajpai, learned counsel for the petitioner, submits that these facts have only come to light by way of pleadings filed in the writ petition, and the petitioner would like to raise these contentions before the disciplinary authority also.

It may be noted that by order dated 25.11.2024, a statement on behalf of the Bank was recorded, to the effect that no final order will be passed in the proceedings until the next date of hearing. That order has held the field since.

After some hearing, the writ petition, alongwith the pending applications, is disposed of with the consent of Mr. Vajpai, instructed by the petitioner in person, and Mr. Jasbir Bidhuri, learned counsel for the Bank, with the following directions:

(a) The Bank will afford an opportunity to the petitioner to place additional submissions, dealing with the action taken against other members of ZLCC and the Review Committee. The petitioner may file a written representation within a period of two weeks from today, and the concerned authority will grant the petitioner an opportunity of hearing within a period of two weeks thereafter. (b) The final order in the disciplinary proceedings will be passed within a period of two months thereafter, after compliance with all required formalities.

(c) The petitioner may exercise remedies available to him against the order of the disciplinary authority, if required. (d) The rights and contentions of the parties on the merits of the allegations against the petitioner, as also on the question of parity with other similarly placed employees, remain reserved.
