The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondent- Municipal Corporation of Delhi (hereinafter, 'MCD') to conduct the survey of the Petitioner and issue him a Certificate of Vending.

The Petitioner claims that he has been vending for the last several years at Vardhman Tower, Nehru Place, Delhi i.e., at least since 2004. The prayer in the present petition is for conducting of the survey and permitting the participation of the Petitioner in the same. It is the claim of the Petitioner that all the challans that were issued to him are lost. Ms. Puja S. Kalra, ld. Counsel appearing for the MCD submits that the survey in this area has been concluded just yesterday and the Petitioner may not be permitted to participate in the survey. 5.

Heard. A perusal of the records would show that there are no challans and even the concerned receipts are not filed. Thus, the Petitioner cannot be permitted to participate in the survey at this stage. 6.

However, if there is any future survey and if the Petitioner is able to file any documents to show that he has been vending for the last several years, then the Petitioner may be permitted to participate in the survey. 7.

Needless to add that this Court has not verified the claims of the Petitioner or the documents placed on record. 8.

This petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
