The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732), assails the orders dated 16th December, 2024, 21st May, 2024, 28th February, 2023, 20th January, 2023 and 20th July, 2022, passed by the Trial Court, as well as the order dated 25th November, 2023, passed by the Sessions Court in CR No. 226/2023. It is urged that by way of the impugned orders, the Petitioner has been precluded from effectively leading defence evidence.

Mr. Sarthak Maggon, counsel for the Petitioner states that during the pendency of the present proceedings, the Petitioner has been convicted in 1 "BNSS"

the case and he has already preferred an appeal against the order of conviction. In these circumstances, Mr. Maggon submits that he would like to withdraw the present petition and urged all the grounds raised herein before the appropriate Court.

Dismissed as withdrawn with liberty as aforesaid. The pending application(s) are also disposed of.
